Acceptance of Terms

By accessing and using the website of primalvectoris AG ("we", "our", or "us") and engaging our home gym space planning services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.

These Terms constitute a legally binding agreement between you and primalvectoris AG, a company registered in Austria with registration number FN648259a and VAT number ATU48263597.

Description of Services

primalvectoris provides professional home gym space planning and design services, including but not limited to:

• Space assessment and planning consultations
• 3D design and layout visualisation
• Equipment selection and recommendation services
• Implementation support and project coordination
• Safety assessments and compliance guidance

User Obligations

When using our services and website, you agree to:

• Provide accurate and complete information during consultations and communications
• Use our services only for lawful purposes and in accordance with these Terms
• Respect our intellectual property rights and those of third parties
• Not attempt to gain unauthorised access to our systems or networks
• Not use our services to engage in any illegal or harmful activities
• Comply with all applicable local, national, and international laws and regulations

Service Agreements and Pricing

Specific terms for individual projects will be outlined in separate service agreements. These may include:

• Client responsibilities and required access to property
• Warranty terms for our design and planning services

All prices are quoted in Euros (EUR) and are subject to applicable Austrian VAT. Payment terms will be specified in individual service agreements.

Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, software, and design elements, is the property of primalvectoris AG or our licensors and is protected by Austrian and international copyright, trademark, and other intellectual property laws.

Design plans, recommendations, and other deliverables created specifically for clients remain the intellectual property of primalvectoris AG, whilst clients receive a licence to use these materials for their intended purpose. Clients may not reproduce, distribute, or create derivative works without our express written permission.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the fullest extent permitted by Austrian law, primalvectoris AG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to your use of our services or website.

Our total liability for any claims arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim. This limitation applies regardless of the legal theory upon which the claim is based.

We provide design and planning services only. We are not responsible for the actual construction, installation, or implementation of recommendations unless specifically agreed in writing. Clients are responsible for ensuring all work complies with local building codes and safety regulations.

Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties that our services will be uninterrupted or error-free
• Warranties regarding the accuracy or completeness of content

Whilst we strive to provide accurate and helpful recommendations, we cannot guarantee specific outcomes or results from implementing our design suggestions.

Indemnification

You agree to indemnify, defend, and hold harmless primalvectoris AG, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or relating to:

• Your use of our services or website
• Your violation of these Terms
• Your violation of any rights of another party
• Implementation of our recommendations without proper professional oversight

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Graz, Austria.

If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights as a consumer under applicable EU consumer protection laws.

Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

You may terminate your use of our services at any time. Termination of ongoing projects will be subject to the specific terms outlined in individual service agreements.

Upon termination, your right to use our services ceases immediately, but the provisions of these Terms that by their nature should survive termination shall remain in effect.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on our website and updating the "Last updated" date. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely reflects the original intent.

Entire Agreement
